1. Acceptance of Terms

These Terms apply to all visitors, property owners, prospective property owners, tenants, prospective tenants, applicants, portal users, and any other users of the Site.

2. About Property Rush Management

Property Rush Management (“PRM,” “we,” “us,” or “our”) provides information and services related to residential property management, leasing, rental listings, tenant support, owner support, maintenance coordination, and related real estate services.

The Site may include, without limitation:

  • information about property management services;
  • available rental listings;
  • owner and tenant FAQs;
  • contact forms and rental-owner inquiry forms;
  • links to owner and tenant/resident portals;
  • rental-related information;
  • maintenance-related information; and
  • other resources related to leasing and property management.

3. Eligibility

You may use the Site only if you are at least 18 years old and legally capable of entering into a binding agreement.

By using the Site, you represent and warrant that:

  • you are at least 18 years old;
  • you have authority to enter into these Terms;
  • all information you provide is truthful, current, and complete; and
  • you will use the Site only for lawful purposes.

4. Informational Purposes Only

The content on this Site is provided for general informational and marketing purposes only.

Nothing on the Site constitutes legal, tax, financial, insurance, housing, investment, or other professional advice. Any rental listing, service description, pricing information, guarantee description, FAQ response, timeline, screening explanation, or market-related statement is subject to change and should not be relied on as the sole basis for any decision.

5. No Guarantee of Availability, Lease Approval, or Results

We do not guarantee:

  • the availability of any rental property;
  • the approval of any rental applicant;
  • a specific leasing timeline;
  • uninterrupted occupancy;
  • any particular financial result for owners;
  • collection of all rent amounts;
  • avoidance of tenant default;
  • or qualification for any guarantee, promotion, or program referenced on the Site.

Any stated guarantees, service descriptions, or timelines may be subject to separate eligibility criteria, exclusions, underwriting, written agreements, operational limitations, or third-party conditions.

6. Rental Listings Disclaimer

Rental listings, property descriptions, photos, amenities, rental rates, deposits, fees, availability dates, pet policies, application requirements, and other listing-related information are subject to change without notice.

We do not warrant that any listing is complete, current, accurate, or available at the time you view it. A listing may be modified, paused, removed, leased, or become unavailable at any time.

7. Applications, Screening, and Leasing

If you submit a rental inquiry, request a showing, create an account, or apply for a rental property, you agree to provide accurate, complete, and truthful information.

We reserve the right, subject to applicable law, to verify submitted information and to use lawful screening procedures in connection with rental applications, including review of identity, rental history, income, credit, criminal background, landlord references, and related information where permitted by law.

Submission of an application or inquiry does not guarantee approval, tenancy, or reservation of any property.

8. Owner and Tenant Portals

The Site may provide access or links to external owner and tenant/resident portals operated by third-party providers.

Your use of any owner portal, tenant portal, payment portal, document portal, or maintenance system may be subject to separate third-party terms, privacy policies, and platform rules. We are not responsible for outages, errors, availability, security issues, or platform functionality provided by third-party portal vendors.

9. Payments and Portal Transactions

If you make payments, submit requests, upload documents, or manage account information through a portal or linked third-party platform, those transactions may be processed by third-party providers.

You are responsible for reviewing and complying with any payment terms, processing rules, fees, timing requirements, or platform policies that apply to those transactions.

10. Separate Agreements Control

Use of this Site does not itself create a property management agreement, lease agreement, brokerage agreement, agency relationship, fiduciary relationship, owner representation agreement, tenant representation agreement, or other contractual relationship beyond these Terms.

If you enter into any separate written agreement with us, including but not limited to a property management agreement, lease, application agreement, owner agreement, or vendor agreement, that separate written agreement will control in the event of any conflict with these Terms as to the subject matter it covers.

11. Month-to-Month, Fees, and Guarantees

Any references on the Site to pricing, flat fees, leasing fees, renewal fees, inspection fees, take-over fees, maintenance coordination charges, month-to-month terms, lease guarantees, eviction guarantees, or similar business terms are informational summaries only.

The actual terms applicable to a client, property, tenant, or owner relationship will be governed by the final written agreement and any applicable eligibility conditions, exclusions, or disclosures.

12. Fair Housing and Legal Compliance

We are committed to compliance with applicable fair housing, landlord-tenant, property management, consumer protection, and real estate laws.

Users may not use the Site to facilitate discrimination, harassment, false statements, unlawful screening requests, or any other unlawful conduct. Nothing in these Terms permits conduct that violates federal, state, or local housing laws.

13. Permitted Use

You may use the Site only for lawful, personal, and legitimate business purposes related to learning about our services, contacting us, managing your relationship with us, or applying for rental housing.

You agree not to:

  • submit false, fraudulent, or misleading information;
  • use the Site to harass, abuse, or threaten others;
  • interfere with Site security or performance;
  • scrape, copy, harvest, or systematically extract Site content or listing data without written permission;
  • attempt to gain unauthorized access to any account, portal, or system;
  • upload malware or malicious code;
  • impersonate any person or entity; or
  • use the Site in violation of law.

14. Intellectual Property

All content on the Site, including text, branding, logos, graphics, page layouts, images, listing presentation materials, blog content, and design elements, is owned by Property Rush, its licensors, or its content providers and is protected by applicable intellectual property law.

You may use the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, republish, display, create derivative works from, or otherwise exploit Site content without prior written permission, except as allowed by law.

15. Third-Party Links and Services

The Site may contain links to third-party websites or services, including portal platforms, payment tools, rental platforms, scheduling tools, social media platforms, review widgets, and other external services.

We are not responsible for the availability, content, accuracy, security, or privacy practices of any third-party website or service. Your use of those services is at your own risk and subject to their own terms and policies.

By contacting us, submitting a form, applying for a rental, requesting property management information, or using portal-related features, you consent to receive communications from us regarding your inquiry, property, tenancy, account, application, maintenance matters, payment issues, service updates, and related operational matters.

Where required by law, marketing communications will be subject to applicable consent and opt-out requirements.

17. Disclaimer of Warranties

THE SITE AND ALL CONTENT, SERVICES, DESCRIPTIONS, FEATURES, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTY RUSH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND FREEDOM FROM ERRORS OR INTERRUPTIONS.

WE DO NOT WARRANT THAT:

  • THE SITE WILL ALWAYS BE AVAILABLE OR SECURE;
  • THE SITE OR PORTALS WILL BE ERROR-FREE;
  • DEFECTS WILL BE CORRECTED;
  • ANY LISTING, FEE, TIMELINE, OR SERVICE DESCRIPTION WILL REMAIN CURRENT;
  • OR ANY RESULT WILL BE ACHIEVED THROUGH USE OF THE SITE.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTY RUSH AND ITS OWNERS, OFFICERS, MEMBERS, BROKERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, RENTAL OPPORTUNITY, OR PROPERTY-RELATED LOSS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

19. Indemnification

You agree to defend, indemnify, and hold harmless Property Rush and its officers, members, brokers, employees, affiliates, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use of the Site;
  • your violation of these Terms;
  • your violation of law;
  • your infringement of any rights of another person or entity; or
  • information you submit through the Site.

20. Suspension and Termination

We reserve the right, in our sole discretion, to suspend, restrict, or terminate access to the Site or any feature of the Site at any time, without notice, for any reason, including suspected misuse, fraud, unlawful activity, or violation of these Terms.

21. Changes to the Site

We may modify, suspend, remove, or discontinue any portion of the Site, including listings, portal links, forms, service descriptions, pricing summaries, blog content, or other features, at any time without notice.

22. Changes to These Terms

We may update these Terms from time to time. Any changes become effective when posted on the Site unless a different effective date is stated.

Your continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms.

23. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

24. Venue

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in or having jurisdiction over Hamilton County, Tennessee, and you consent to that jurisdiction and venue.

25. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

26. Entire Agreement

These Terms, together with any incorporated policies and any separate written agreements applicable to a specific relationship or transaction, constitute the entire agreement between you and Property Rush regarding use of the Site.
