If you submit a rental inquiry, request a showing, create an account, or apply for a rental property, you agree to provide accurate, complete, and truthful information.
We reserve the right, subject to applicable law, to verify submitted information and to use lawful screening procedures in connection with rental applications, including review of identity, rental history, income, credit, criminal background, landlord references, and related information where permitted by law.
Submission of an application or inquiry does not guarantee approval, tenancy, or reservation of any property.
The Site may provide access or links to external owner and tenant/resident portals operated by third-party providers.
Your use of any owner portal, tenant portal, payment portal, document portal, or maintenance system may be subject to separate third-party terms, privacy policies, and platform rules. We are not responsible for outages, errors, availability, security issues, or platform functionality provided by third-party portal vendors.
If you make payments, submit requests, upload documents, or manage account information through a portal or linked third-party platform, those transactions may be processed by third-party providers.
You are responsible for reviewing and complying with any payment terms, processing rules, fees, timing requirements, or platform policies that apply to those transactions.
Use of this Site does not itself create a property management agreement, lease agreement, brokerage agreement, agency relationship, fiduciary relationship, owner representation agreement, tenant representation agreement, or other contractual relationship beyond these Terms.
If you enter into any separate written agreement with us, including but not limited to a property management agreement, lease, application agreement, owner agreement, or vendor agreement, that separate written agreement will control in the event of any conflict with these Terms as to the subject matter it covers.
Any references on the Site to pricing, flat fees, leasing fees, renewal fees, inspection fees, take-over fees, maintenance coordination charges, month-to-month terms, lease guarantees, eviction guarantees, or similar business terms are informational summaries only.
The actual terms applicable to a client, property, tenant, or owner relationship will be governed by the final written agreement and any applicable eligibility conditions, exclusions, or disclosures.
We are committed to compliance with applicable fair housing, landlord-tenant, property management, consumer protection, and real estate laws.
Users may not use the Site to facilitate discrimination, harassment, false statements, unlawful screening requests, or any other unlawful conduct. Nothing in these Terms permits conduct that violates federal, state, or local housing laws.
You may use the Site only for lawful, personal, and legitimate business purposes related to learning about our services, contacting us, managing your relationship with us, or applying for rental housing.

We are not responsible for the availability, content, accuracy, security, or privacy practices of any third-party website or service. Your use of those services is at your own risk and subject to their own terms and policies.
By contacting us, submitting a form, applying for a rental, requesting property management information, or using portal-related features, you consent to receive communications from us regarding your inquiry, property, tenancy, account, application, maintenance matters, payment issues, service updates, and related operational matters.
Where required by law, marketing communications will be subject to applicable consent and opt-out requirements.
THE SITE AND ALL CONTENT, SERVICES, DESCRIPTIONS, FEATURES, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTY RUSH AND ITS OWNERS, OFFICERS, MEMBERS, BROKERS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, RENTAL OPPORTUNITY, OR PROPERTY-RELATED LOSS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in or having jurisdiction over Hamilton County, Tennessee, and you consent to that jurisdiction and venue.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with any incorporated policies and any separate written agreements applicable to a specific relationship or transaction, constitute the entire agreement between you and Property Rush regarding use of the Site.
